2. Promoter and society
The Lottery is promoted on behalf of Kemnay Breakfast and After School Club SCIO by the Promoter, a member of the Society authorised in writing by its Board of Trustees. The Promoter can be contacted at [email protected] or by post at Kemnay Primary School, Grove Road, Kemnay AB51 5RA. No external lottery manager is used.
3. Registration and legal limits
The Lottery is a small society lottery under Part 5 and Schedule 11 of the Gambling Act 2005, registered with Aberdeenshire Council (Licensing). The Society is a non-commercial society. In line with the law:
- total ticket sales for any single Draw will not exceed £20,000, and total lottery proceeds in a calendar year will not exceed £250,000;
- at least 20% of the proceeds of each Draw is applied to the purposes of the Society (KBASC applies 50%);
- no single prize will exceed £25,000;
- a return is sent to Aberdeenshire Council within three months of each Draw, and records of each Draw are kept for at least one year.
4. Eligibility
- Players must be aged 18 or over. The legal minimum age for lotteries is 16; the Society applies a higher age limit of 18.
- Players must live in Great Britain.
- Trustees, staff and volunteers who conduct or witness a Draw may not enter that Draw.
- A person who has self-excluded under rule 13 may not play during the exclusion period.
- The Society may ask any Player for proof of age and identity at any time. If proof is not provided within 14 days, Numbers may be suspended.
- Any entry found to be from a person under 18 will be cancelled, all payments refunded and any prize forfeited. It is an offence to invite or allow a person under 16 to enter a lottery.
5. Ticket price and entry
- Each Number costs £5 per Draw. Each Player may hold a maximum of 10 Numbers per Draw.
- Numbers run from 1 to 200, and each Number may be held by only one Player at a time. The maximum sale per Draw is therefore £1,000.
- Applications are made using the form on the Society's website, by email or on paper. Tickets will not be sold in any street or to any person under 18.
- Each Player receives written or emailed confirmation of their Numbers, which serves as their ticket and states: the name of the Society; the name and contact address of the Promoter; the date of the Draw (or how it is determined); the price; and that the Lottery is registered with Aberdeenshire Council.
- A Number is entered in a Draw only if payment for that Draw has been received by midnight on the Wednesday before the Draw.
- Payment is by standing order or bank transfer only. The Society does not accept payment on credit.
- Numbers are not transferable without the Society's written agreement.
6. Subscriptions and cancellation
- Monthly Players remain entered for as long as their standing order is paid.
- Players may cancel at any time by cancelling their standing order and telling the Society at [email protected]. Numbers are released after the next Draw.
- Payments received after cancellation will be refunded.
- If a standing order payment is missed, the Number is not entered in that Draw. After two missed payments, the Number may be released.
7. The draw
- Draws take place at 7pm on the last Friday of each calendar month, except in December, when the Draw takes place on the Friday before 25 December. The Society will publish any change of date on its website at least 14 days in advance.
- Three winning Numbers are selected at random from all paid-up Numbers using a random number generator, in the presence of two trustees who have not entered that Draw.
- A written record of each Draw (date, entries, winning Numbers, witnesses) is kept for at least one year.
8. Prizes
- 50% of the ticket proceeds of each Draw forms the prize fund, divided as follows: 1st prize 50%, 2nd prize 30%, 3rd prize 20%.
- Prizes are rounded down to the nearest whole pound; any remainder goes to the Society.
- Each Number can win only one prize per Draw. There are no rollovers.
- The prize amounts for each Draw are published with the results.
9. Notifying and paying winners
- Winners are contacted by email or phone within 2 working days of the Draw.
- Prizes are paid by bank transfer to the Player named on the application within 14 days of the Draw, after any age or identity checks.
- Winning Numbers are published on the Society's website and Facebook page. Winners' initials and town are published only with their consent.
10. Unclaimed prizes
If a winner cannot be contacted or does not claim within 90 days of the Draw, the prize is forfeited and applied to the purposes of the Society.
11. Use of proceeds
The Society's share of the proceeds (50%) is used for the purposes of the Society: the care, education and recreation of children attending Kemnay Breakfast and After School Club. Reasonable expenses of running the Lottery are met from the Society's share and will not exceed the limits set by law.
12. Responsible gambling
The Society is committed to socially responsible gambling. We set a low maximum stake, do not offer credit, do not market the Lottery to children, and provide information about support on our lottery page and Responsible Gambling page. Players may reduce their Numbers or take a break of 1, 3 or 6 months at any time.
13. Self-exclusion
- Any Player may self-exclude from the Lottery for a minimum of 6 months, or permanently, by emailing [email protected].
- We will act within 2 working days: cancel the Player's Numbers, refund any payments received for future Draws, remove them from lottery communications and refuse any new application during the exclusion.
- A self-exclusion cannot be cancelled before the end of the chosen period. At the end of a fixed period, the Player must contact us to rejoin.
14. Liability
The Society is not responsible for applications or payments that are lost, delayed or incomplete, or for errors made by banks. If an error by the Society means a Number was wrongly excluded from a Draw, the Player's liability is limited to a refund of the price of that entry.
15. Complaints and disputes
- Complaints should be sent to the Promoter at [email protected] or by post to the Society's address. We will acknowledge within 5 working days and respond fully within 21 days.
- If you remain unhappy, the complaint will be reviewed by the Chair of the Board of Trustees, whose decision is final in respect of the Society.
- You may also contact Aberdeenshire Council's Licensing Section, which registers the Lottery, or find out about your rights on the Gambling Commission website.
16. Data protection
Personal information is used to run the Lottery, verify age, pay prizes, meet legal record-keeping duties and handle self-exclusion, as described in our Privacy Policy.
17. Changes to these rules
The Society may amend these rules. Changes will be published on the website at least 14 days before they take effect, except where required by law. By continuing to play, Players accept the amended rules.
18. Governing law
These rules are governed by the law of Scotland, and the Scottish courts have jurisdiction.
